1. General
The following Terms of Use apply to all orders placed by the customer (hereinafter referred to as “customer” or “you”) with Linkcare Healthcare Services S.L., hereinafter referred to as “Linkcare”, “us” or “we”, at the Linkcare Bioscreeening website, mobile website, or telephone (jointly referred to as “the web”).
By using the web and/or placing an order, you agree to be bound by the terms and conditions set out (herein the “Terms of Use”). Please make sure you have read and understood the Terms of Use before placing your order.
Only public or private companies, health centers, hospitals, clinics, medical suppliers, foundations and medical professional freelancers can place an order. Linkcare reserves the right to restrict different areas for delivery.
The inclusion of any products or services on the web at a particular time does not imply or warrant that these products or services will be available at any time. We reserve the right to discontinue any product at any time.
We reserve the right to amend these Terms of Use from time to time without prior notice. The version of the Terms of Use that will apply to your order will be those on the web at the time the order is placed.
Linkcare wants to provide the best possible online experience. To make this possible we need to ensure that our services run like a clockwork. You understand and agree not to (I) post, transmit, redistribute, upload, or promote any communications or content that could harm or negatively impact our business, products or services; (II) act in a manner or employ any device that restricts, impairs, interferes or inhibits any other users from using or enjoying the the web site, or which impacts the security of the site, or (III) employ any device or attempt to use any engine, software, tool, agent, script or other device or mechanism (including, but without limitation to spiders, bots, crawlers, avatars or intelligent agents) to navigate, search the site or to copy content from the site. We reserve the right to immediately bar access to the site and close the account of any user who violates this provision or any other provision in these Terms of Use.
2. Prices and delivery charges
The prices displayed at the web do not include Value Added Tax nor does it include a delivery charge. However, the customer is able to see Value Added Tax and delivery charge on shopping cart page as well as the billing page.
3. Ordering placing, payments and cancellations
Product available only for professionals, health services, residences, health managers of sports facilities and companies authorized by their occupational risk prevention service. Orders can be placed via the web or via email through contact@linkcareapp.com.
Orders placed through the web shop, will receive a confirmation email, as well as an invoice and an order being shipped email. Orders placed through the email contact@linkcareapp.com will receive an invoice to the provided email address, which will need a confirmation and proof of payment (receipt) before the order is processed and shipped. If for any reason we are unable to fulfil your order, we will let you know at the earliest opportunity.
Orders can only be cancelled before the shipping of the medical material. If we have already received payment for such order and the order hasn’t been shipped, we will attempt to refund the applicable amount using the same method used to make the payment. When canceling an order, you will be notified via email of the successful cancellation. An order cannot be cancelled after it has been shipped. Cancellations cannot be confirmed or cancelled via telephone.
You can create a user account to manage your purchases and save your personal settings. The data provided by you (your name, email address, telephone number, payment details, etc.) will be used by authorized personnel only, and will be used solely for the purposes of customer orders and support.
In the event of an error in connection with any products or services displayed through the web (including typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, promotions, offers, and availability), Linkcare reserves the right to cancel any order prior to the time it is delivered to you.
4. Delivery
Linkcare exercises the utmost diligence in accepting and processing orders and will endeavor to deliver your order. In Spain (peninsula), you will receive your order within 2 days of receiving the email of your order being shipped. If you are from Canary Islands, Ceuta or Melilla, you will receive an email with a shipping estimate as we process your order.
5. Payment methods
The Linkcare web can accept all major credit cards: American express, Visa and MasterCard. For wholesales, you can contact us directly, and pay through a deposit in our bank account. Please note that Linkcare reserves the right to send payment requests to your e-mail address.
Please note that we are unable to accept gift cards and merchandise cards as forms of payments via Linkcare.
You will receive the legally required invoice in the shipping confirmation e-mail.
6. Our Liability
Nothing in these Terms of Use shall exclude or limit Linkcare’s liability with regard to any matter for which it would be unlawful for us to limit or exclude our liability.
We do not seek to exclude liability for fraudulent misrepresentation by us or our employees or agents. If we breach these Terms of Use, we shall only be liable for losses which are a reasonably foreseeable consequence of such breach.
Linkcare is not responsible for indirect losses which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to deliver the goods or to meet any of our other obligations under these Terms of Use where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident and terrorist activity.
Our maximum liability to you for any loss or damage arising in connection with your order on the web shall be limited to the total price of your order.
7. Guarantee
If there are defects in the goods you have purchased, Linkcare abides by all statutory guarantee regulations. If you have a complaint regarding obvious material or manufacturing faults in goods that we have supplied, please let us know by contacting us through our email contact@linkcareapp.com or through the telephone provided in the section of https://www.seroscreening.com/contact/.
8. Assignment
Linkcare reserves the right to assign or pledge to third parties any claim(s) for payment which have arisen in connection with the delivery of goods.
9. Severance
If any part of these Terms of Use is disallowed or found to be ineffective by any court or regulator, the other Terms of Use shall continue to apply.
10. Ownership of rights
All intellectual property rights, such as trademarks and copyrights at the web remain with Linkcare Health Services S.L. Any use of the web or its contents, including copying or storing such content in whole or part, other than for your own personal, non-commercial use, is prohibited without the permission of Linkcare.
